These Terms & Conditions ("Terms") govern your access to and use of the ONCO-TRIAGE™ website, courses, memberships, downloads, and related educational materials (the "Service") provided by TBtheOncNP, LLC("we", "us", "our"). By using the Service you agree to these Terms.

1. Who you are contracting with

The Service is provided by TBtheOncNP, LLC. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you are using it as an individual, you confirm you are of legal age in your jurisdiction.

2. What the Service is

ONCO-TRIAGE™ delivers practical oncology education for advanced practice providers (nurse practitioners and physician assistants) and other clinicians who want to build confidence in oncology triage, exam-room assessment, and toxicity management. Content is educational and is not medical advice. Clinical decisions remain the responsibility of the licensed clinician caring for the patient.

3. Accounts and accurate information

You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.

4. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, fraudulent, or abusive.
  • Infringe intellectual property or other rights of TBtheOncNP, LLC or third parties.
  • Attempt to interfere with the security or integrity of the Service (malware, probing, scraping, circumventing access controls).
  • Share, resell, sublicense, or redistribute course content, downloads, or membership access.
  • Reverse engineer or attempt to derive the source of the platform.

5. Intellectual property

All content, curriculum, brand marks (including ONCO-TRIAGE™ and TBtheOncNP), graphics, videos, cheat sheets, and written material are owned by TBtheOncNP, LLC or its licensors. You receive a limited, non-exclusive, non-transferable right to access and use the content for your own professional learning within the plan you purchased.

6. Payments, billing, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. Refund eligibility is described on our Refund Policy page.

7. Educational content — not medical advice

ONCO-TRIAGE™ materials are for professional education only. They do not replace institutional protocols, guidelines, or the clinical judgment of a licensed provider. Nothing on the Service establishes a provider-patient relationship. Always follow your own institution's policies and applicable law.

8. Service availability

We work hard to keep the Service available, but we do not guarantee it will be uninterrupted, timely, secure, or error-free. Features may change as the curriculum evolves.

9. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. To the extent permitted by law, TBtheOncNP, LLC's aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

10. Indemnity

You agree to indemnify and hold TBtheOncNP, LLC harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your infringement of third-party rights.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination your right to use the Service ends.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated on this page or by email. Continued use of the Service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state in which TBtheOncNP, LLC is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
